THESE TERMS OF USE (“TERMS”) CONTAIN A CLASS ACTION LIMITATION THAT AFFECTS YOUR RIGHTS REGARDING HOW DISPUTES ARE RESOLVED. PLEASE READ SECTION 14 CAREFULLY.
The dropmil.com website (the “Site”) is owned and operated by The Weather Company Government Solutions, LLC (“TWCGS”, “we”, “us” or “our”). These Terms are between TWCGS and you (“you” or “your”). By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, you may not use the Site.
The Site provides information about the Dynamic Risk Operations Platform (DROP) and related products and services (the “Services”). The Site is hosted by Shopify. The Site is intended for use by individuals who are at least 18 years of age or the age of majority in their jurisdiction, whichever is greater. By using the Site, you represent that you meet this age requirement. We reserve the right to change these Terms at any time by posting the revised Terms on the Site. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.
1. PERMITTED USE
You may use the Site and all information, content, images, text, and other materials available on it (collectively, the "Content") only for your personal, non-commercial informational purposes. You may access, view, and make copies of the Content solely for your personal, non-commercial use. You may not use the Site or the Content to sell a product or service, to advertise, to direct activity to other websites, or for other commercial activities, without our prior written consent.
2. OWNERSHIP; TRADEMARKS
The Site and Content are protected by copyrights, trademarks, service marks, patents, and other proprietary rights and laws. You do not acquire any ownership, license, or other proprietary interest in the Site or Content by accessing or using the Site. All trademarks, service marks, trade names, and logos displayed on the Site, including DROP, DROP Black, DROP Red, The Weather Company, and associated logos, are the property of TWCGS or its affiliates. Nothing on the Site grants any license or right to use any trademark, service mark, or logo without the prior written consent of its owner.
3. PRIVACY POLICY
By using the Site, you also agree to the DROPmil Privacy Policy, which describes the collection, use, sharing, and storage of your information, including personal data.
4. INFORMATIONAL PURPOSES ONLY
The Content on this Site, including all product descriptions, specifications, use cases, and performance claims, is provided for general informational and marketing purposes only. Nothing on this Site constitutes operational guidance, tactical advice, or a recommendation to rely on any product or data for mission planning, execution, or any decision involving the safety of persons or property. Use of DROP products is governed solely by the applicable product agreement between TWCGS and the customer.
5. COPYRIGHT
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide the following information in writing, as required by the Digital Millennium Copyright Act, 17 U.S.C. § 512, to our Copyright Agent identified below:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a list of such works;

We are not responsible for the content, privacy practices, or availability of any linked websites. If you access any third-party website through the Site, you do so at your own risk.
7. LIMITATION OF LIABILITY; DISCLAIMER
TWCGS assumes no responsibility for, and shall not be liable for, any damages or expenses you may incur as a result of any inaccuracy, incompleteness, or obsolescence of any Content on the Site. THE SITE AND ALL CONTENT ARE PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND. TWCGS DISCLAIMS ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, CURRENCY, OR RELIABILITY OF THE CONTENT, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR OTHERWISE ARISING BY LAW OR STATUTE.
Without limiting the foregoing, you agree that neither TWCGS nor any of its affiliates, employees, or agents will be liable to you or to any other party for any direct, indirect, special, exemplary, punitive, incidental, consequential, or other damages (including lost profits or lost time), whether based on contract, tort, strict liability, or otherwise, arising out of or connected with any access to the Site or any use of the Content. You acknowledge that the limitations in this Section are reasonable and appropriate.
8. EXPORT CONTROLS
The Site and Content may be subject to U.S. export control and sanctions laws and regulations. You may not access or use the Site in violation of any applicable U.S. export control laws, trade sanctions, or other restrictions. You represent that you are not located in, or a national or resident of, any country subject to U.S. trade sanctions, and that you are not on any U.S. government restricted party list.
9. UNAUTHORIZED USE; NO INTERFERENCE
You agree that you will not use or attempt to use any method, device, software, or routine to harm others or interfere with the functioning of the Site, or to use or monitor any information on the Site for any unauthorized purpose. Without limiting the foregoing, you agree that you will not:

10. AUTOMATED ACCESS; SCRAPING
You may not use any robot, spider, crawler, scraper, or other automated means to access, index, or collect any Content from the Site, whether for purposes of training or developing machine learning models, artificial intelligence systems, large language models, or any other technology, or for any other purpose, without the prior written consent of TWCGS. This prohibition applies regardless of whether such access is performed directly or through a third party. Any access to the Site in violation of this Section constitutes unauthorized use. TWCGS reserves the right to block automated access and to pursue all available remedies for violations of this provision.
11. INDEMNIFICATION
You agree to indemnify and hold harmless TWCGS, its affiliates, officers, employees, and agents from and against any loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Site or any violation of these Terms.
12. VIRUSES
We will use commercially reasonable efforts to maintain the Site free of viruses and other harmful components. We are not, however, responsible for any viruses or other harmful components that may affect your computer equipment or other property as a result of your access to or use of the Site. We do not warrant that the Site or its servers are free from viruses, bugs, or other harmful components.
13. MODIFICATIONS; TERMINATION
Without limiting its other remedies, TWCGS may immediately discontinue, suspend, terminate, or block your access to the Site at any time in its sole discretion. TWCGS may amend or modify these Terms at any time by posting on the Site. Any such changes become effective immediately upon posting. You agree to be bound by the revised Terms. It is your responsibility to review these Terms periodically for changes.
14. CLASS ACTION LIMITATION
You and TWCGS agree that neither party will sue the other as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class action lawsuit against the other. Nothing in this Section limits your rights or TWCGS's rights to bring a lawsuit against the other as an individual plaintiff.
15. GOVERNING LAW; JURISDICTION
These Terms, and your access to and use of the Site, are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. In the event of any dispute regarding the interpretation or compliance with these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in the Northern District of Georgia.
16. NOTICE
All notices contemplated by these Terms will be in writing. TWCGS may provide notice to you through the Site or via email, in TWCGS's discretion or where required by law. All notices to TWCGS should be addressed to:

17. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and TWCGS governing your access to and use of the Site and Content. Any waiver of any term or condition shall not be effective unless in a written document signed by an authorized representative of TWCGS.
